801682) (‘the Trust’). Your use of this website is subject to the following
Terms & Conditions of Use, which you are deemed to accept by using the
website.
1. Copyright
The copyright and all other rights relating to the design of and material
contained on this website are owned by and shall be retained by the Trust.
2. Prohibited use
2.1 The purpose of this website is to enable charities to have a reliable
source of information that they can make full use of and can provide
information and materials found to those whom they think might benefit from
them. The Trust does however need to ensure that this website is not abused
or unfairly exploited which is why certain conditions on use of it are
imposed under these Terms & Conditions of Use.
2.2 Subject to paragraph 2.3 below, material from this website may be
downloaded, viewed, listened to (where appropriate), printed, copied on the
hard disk of your computer, photocopied in reasonable numbers and used for
your organisation’s non-commercial purposes in good faith ONLY. Any other
type of use shall require the prior written agreement of the Trust and use
without such agreement shall be a breach of these Terms & Conditions of Use.
2.3 In using the website you agree and undertake not to use it:
- to create a database (electronic or otherwise) that includes
material downloaded or otherwise obtained from this website except (i)
if you are a charity, within your charitable purposes; or (ii) to the
extent expressly permitted on the website;

(which would include using the website to promote or encourage the sale
of your goods/services);
- to transmit or re-circulate any material obtained from this website
to any third party except where expressly permitted on the website;
- in such a way so as to remove the copyright or trade mark notice(s)

3.1 Whilst the Trust takes every care to ensure that the information
contained on this website is accurate and complete, some of it may be
supplied to us by third parties and we are unable to check its accuracy or
completeness and you are advised to verify the accuracy of any information
before relying on it.
3.2 Due to the inherent nature of the Internet, errors, interruptions and
delays may occur in the service at any time. Accordingly, this website is
provided on an ‘AS IS’ and ‘AS AVAILABLE’ basis without any warranties of
any kind.
3.3 The Trust hereby excludes to the fullest extent possible at law all
liability arising from use of the website and any interruption in its
availability.

4.1 You may be offered automatic links on the website to other websites.
4.2 Whilst the Trust hopes that you will be interested in those websites
and find them useful, you acknowledge that the content on those pages is not
subject to the Trust’s control and that the Trust does not endorse or accept
any responsibility for their content.
5. Computer viruses
5.1 The Trust will use reasonable endeavours to ensure that the website
does not contain or promulgate any viruses or other malicious code. However,
it is recommended that you should virus check all materials downloaded from
the website and regularly check for the presence of viruses and other
malicious code.
5.2 The Trust hereby excludes to the fullest extent permitted by
applicable laws all liability in connection with any damage or loss caused
by computer viruses or other malicious code originating or contracted from
the website.

No use of the Trust’s (registered or unregistered) trade marks shall be
made by you except for the purpose of referring to the Trust lawfully and in

from time to time. Such variations shall become effective immediately upon
the posting of the varied Terms & Conditions of Use on the website. By
continuing to use the website you shall be deemed to accept such variations.
7.2 The Trust reserves absolutely the right to withdraw or suspend the
website where it deems this to be necessary without notice and will not be
liable to you for such unavailability.
7.3 Nothing in these Terms & Conditions of Use shall restrict or exclude
any liability that we have to any party which cannot be excluded by law and
in particular, and notwithstanding any term of these Terms & Conditions of
Use, our liability for death or personal injury caused by our negligence or
fraudulent misrepresentation shall not be limited or excluded in any way.
7.4 In the event that any term of these Terms & Conditions of Use is held
to be invalid or unenforceable, the remainder of these Terms & Conditions of
Use shall remain valid and enforceable.
7.5 These Terms & Conditions of Use shall be governed by English law and
the courts of England and Wales shall have exclusive jurisdiction.
